This statement addresses 18 U.S.C. §2257 and §2257A, and their implementing regulations at 28 C.F.R. Part 75, which impose record-keeping and labeling requirements on producers of certain visual depictions of "actual sexually explicit conduct" involving real, identifiable performers.
1. Why Pinkerton AI is exempt
Pinkerton AI is an AI generation platform. All image, video, and text output produced through the Service is synthetically generated by machine-learning models from user text prompts. No content offered, produced, reproduced, or distributed through the Service depicts an actual, identifiable real person engaged in actual sexually explicit conduct, and the Service does not photograph, film, or otherwise record real performers. Because 18 U.S.C. §2257 and §2257A apply to primary and secondary producers of such actual depictions, the record-keeping and labeling requirements of these statutes and 28 C.F.R. Part 75 do not apply to content generated through the Service.
2. What this statement does not cover
This exemption statement addresses federal record-keeping law only. It does not affect — and should not be read to limit — our absolute prohibition on generating, requesting, or distributing any content that sexualizes, exploits, or depicts a minor, synthetic or otherwise. That prohibition, and our zero-tolerance enforcement of it, is set out in section 3 of our Terms of Use and in our Content Removal Policy.
3. Age assurance
The Service does not knowingly permit minors to use age-restricted features. Users represent, by using the Service, that they are at least 18 years old or the age of majority in their jurisdiction (see section 1 of our Terms of Use).
4. Reporting suspected violations
If you believe content generated through the Service depicts, sexualizes, or otherwise involves a minor, report it immediately to contact@pinkerton-ai.com. See our Content Removal Policy for our response process, which includes immediate removal, permanent suspension of the responsible session, and reporting to the relevant authority (for example NCMEC in the United States) where legally required or able to do so.
